Introduction
The owner and operator of the Ermitage® brand (Registered Trademark No. 85543, Republic of Cyprus) trading as Ermitage Pro Access (“we”, “us”, “our”) is committed to protecting the personal data of our Subscribers and website visitors in full compliance with EU Regulation 2016/679 (GDPR) and Cyprus Data Protection Law, Law 125(I)/2018.
This Privacy Policy explains what personal data we collect, why we collect it, how we process it, and the rights you have in relation to your data. It applies to all individuals whose data we process in connection with the Ermitage Pro Access membership service.

Article 2. Categories of Personal Data Collected
2.1 Identity and Contact Data
Full name, business name, email address, telephone number, business address, VAT number (where provided).
2.2 Account Data
Username, login credentials (stored in hashed form), account preferences, subscription status, activation date.
2.3 Transaction and Financial Data
Membership purchase records, payment confirmation, invoice details, Product Credit balance. Full card numbers are not stored — payment data is processed by our third-party payment processor.
2.4 Usage and Behavioural Data
Order history, savings tracker data, frequency and volume of orders, session logs, IP address, browser type, device information.
2.5 Communication Data
Records of communications between you and the Provider (email, WhatsApp, support tickets).
2.6 Professional Verification Data
Business registration information or evidence of professional status provided during account activation.
Article 3. Legal Bases for Processing
We process personal data on the following legal bases under Article 6 GDPR:
Art. 6(1)(b) Performance of a Contract — to activate and manage your subscription, process payments, and deliver the Service.
Art. 6(1)(c) Legal Obligation — to comply with tax law, financial reporting, and regulatory requirements under Cyprus and EU law.
Art. 6(1)(f) Legitimate Interests — for fraud prevention, security monitoring, and Service improvement, where not overridden by your rights.
Art. 6(1)(a) Consent — for marketing communications, non-essential cookies, and promotional profiling. Consent may be withdrawn at any time.
Article 4. Purposes of Processing
4.1 Account creation, authentication, and Pro Access membership management.
4.2 Processing orders, applying Professional Pricing, and maintaining the savings tracker.
4.3 Issuing invoices and managing billing records per tax obligations (VAT Directive 2006/112/EC; Cyprus VAT Law N.95(I)/2000).
4.4 Sending transactional communications: activation confirmation, order receipts, renewal notices.
4.5 Sending marketing communications regarding member-exclusive offers and course promotions — with consent or under legitimate interests in the existing business relationship.
4.6 Fraud prevention, security, and compliance with applicable legal obligations.
4.7 Responding to enquiries and providing customer support.
Article 5. Data Retention
5.1 Active subscription data is retained for the duration of the subscription plus seven (7) years post-termination, in accordance with Cyprus tax obligations (Cyprus Income Tax Law, Cap. 297, Art. 35).
5.2 Transaction and invoice records are retained for a minimum of seven (7) years to comply with VAT and financial reporting obligations.
5.3 Marketing consent records are retained for the duration of consent plus three (3) years.
5.4 Communication records are retained for three (3) years from the date of the communication.
5.5 Upon expiry of the applicable retention period, data is securely deleted or anonymised per Article 5(1)(e) GDPR (storage limitation).
Article 6. Data Sharing and Transfers
6.1 We do not sell personal data to third parties.
6.2 We may share data with: (a) payment processors; (b) cloud hosting providers; (c) email service providers; (d) analytics providers (with consent); (e) legal and tax advisors; (f) public authorities where required by law.
6.3 All third-party processors are bound by Data Processing Agreements (DPAs) under Article 28 GDPR.
6.4 Transfers outside the EEA are made with appropriate safeguards: Standard Contractual Clauses (SCCs) under Article 46(2)(c) GDPR or adequacy decisions under Article 45 GDPR.
Article 7. Your Rights Under GDPR
Under Articles 15–22 GDPR and Cyprus Law 125(I)/2018, you have the following rights:

Art. 16 Right to Rectification — to correct inaccurate or incomplete data.
Art. 17 Right to Erasure (‘Right to be Forgotten’) — to request deletion where no legal basis for retention remains.

Art. 20 Right to Data Portability — to receive data in a structured, machine-readable format.
Art. 21 Right to Object — to object to processing based on legitimate interests or for direct marketing.

Article 8. Cookies and Tracking Technologies
8.1 We use cookies in accordance with EU ePrivacy Directive 2002/58/EC and Cyprus L.112(I)/2004.
8.2 Strictly necessary cookies are placed without consent as they are essential for Service operation.
8.3 Analytical, functional, and marketing cookies are placed only upon explicit consent, withdrawable via our cookie management tool.
Article 9. Security Measures
9.1 We implement technical and organisational measures per Article 32 GDPR, including: TLS/SSL encryption, password hashing, access controls, and regular security assessments.
9.2 In the event of a personal data breach, we will notify the Cyprus Commissioner within seventy-two (72) hours under Article 33 GDPR, and affected individuals under Article 34 GDPR where required.
Article 10. Changes to This Policy
10.1 Material changes will be communicated by email at least thirty (30) days before taking effect.
10.2 Continued use of the Service after the effective date constitutes acceptance of the revised Policy.

Return Procedure
Provide your order number and an explanation of why you want to return it, including any proof images. The product must be in its original, unopened packaging and in perfect condition.
Replacement & Credit

- A full refund via the original payment method (excluding delivery costs).
- A full refund as store credit for future purchases, valid for six (6) months (excluding delivery costs).

- Store credit for future purchases, valid for six (6) months (excluding delivery costs).
Exclusions
Products cannot be returned after thirty (30) days except for defective items with a longer warranty period.
Return of Incorrect/Defective Products
Incorrect products refer to items received with a different color, size, or quantity than ordered. Defective products refer to items received in a defective state according to the law. You have the right to return incorrect or defective products within thirty (30) days of receipt for a full refund.
Procedure for Returning Incorrect/Defective Products
Provide your order number and an explanation of why you want to return it, including any proof images. The product must be in its original packaging and in perfect condition.

5. Delivery and Shipping
Delivery Methods and Days
- Home delivery from Monday to Friday, with an estimated processing time of five (5) days.
- Collection from designated courier stores with an estimated processing time of five (5) days. Delays may occur during high order volumes.

Delivery costs vary by weight and are displayed at checkout. For deliveries outside Cyprus, contact us for exact costs.
Delivery Terms
Our staff delivers products to your premises. Delivery takes place outside your premises; products are not transported via stairs or elevators. Ensure someone is available to receive the delivery during the agreed time slot.
